Terms of Service

Effective Date: April 23, 2024

In short, our agreement is that I will perform the design work we agree upon, you will provide timely feedback and payment, and you will own 100% of the final Intellectual Property we create for your project. The details below make this official.

1. Services & Scope

Charles Edward Kurowski provides professional tabletop game design, independent game development, and strategic consultation services. Each project begins with a clear, detailed Statement of Work (SOW) that outlines the specific services, deliverables, timelines, and mutual responsibilities for your unique project. This SOW, once signed by both parties, will serve as the definitive guide for our collaboration, ensuring a precise understanding of the game design contract and expected outcomes.

2. Intellectual Property Rights

Your creative vision becomes your property.

Upon full and final payment for the services rendered as per the agreed SOW, you, the client, will be granted full ownership of all final, approved designs, artwork, rulesets, and other creative outputs specifically developed for your project ("Client IP"). This ensures that you retain complete intellectual property rights to your unique board game or custom gift design.

Charles Edward Kurowski retains the right to display the completed work in a professional portfolio, website, or marketing materials for promotional purposes, provided that any sensitive or proprietary information agreed to be confidential in the SOW is not disclosed. Any pre-existing tools, methodologies, general design principles, or non-project-specific ideas ("Designer IP") employed during the creation process remain the sole property of Charles Edward Kurowski.

3. Payment & Fees

Our standard payment structure typically involves an initial deposit of 50% of the total project fee due upfront to commence work. The remaining 50% balance is due upon project completion and before the final delivery of files. All fees and payment schedules will be clearly stipulated in your project's Statement of Work (SOW), forming a crucial part of our design agreement.

Accepted payment methods include bank transfer, PayPal, and major credit cards (through secure processing platforms). In the event of late payments, a late fee of 5% per month may be applied to the outstanding balance, ensuring adherence to the service terms agreed upon.

4. Revisions & Cancellation

Each SOW will specify the number of revision rounds included within the project scope. Additional revision requests beyond the included amount will be outlined in terms of cost and timeline. Our goal is to refine your project collaboratively through structured feedback, ensuring satisfaction while managing project scope effectively.

Should either party need to terminate a project, a clear cancellation policy will be detailed in the SOW. Typically, if a project is canceled by the client, the initial deposit is non-refundable, covering work performed up to that point and reserving the designer's time. If Charles Edward Kurowski initiates cancellation due to unforeseen circumstances, a pro-rata refund for uncompleted work will be issued. This forms a key part of our game design contract, protecting both parties.
